Burglary is defined as the crime of entering a dwelling, structure, or vehicle with the intent to commit a crime, unless the premises are open to the public or the defendant was invited to enter.  It is also a crime to enter and hide in a dwelling, structure, or vehicle in order to carry out a crime.

If a person enters a building, dwelling, or vehicle armed with a weapon, or commits assault and battery against another person on the premises, it is considered a first degree felony, punishable by up to a lifetime in prison and $15,000 in fines.  A person will also face first degree burglary charges if they cause damage to the structure or dwelling, or if they use a motor vehicle to assist in the commission of a crime, causing damage to a structure or dwelling. 

Unlawfully entering a dwelling, regardless of whether or not someone is inside, is a second degree felony, punishable by up to 15 years in prison and $10,000 in fines.  The charges for unlawfully entering a structure or vehicle depend on whether or not someone was inside.  If a person is inside the structure or vehicle when the defendant makes an unlawful entry, it is considered a 2nd degree felony. If no one is in the building or vehicle when the defendant makes his or her entry, it is a 3rd degree felony, punishable by 5 years in prison and $5,000 in fines.
